These Terms of Service (“Terms”) are a contract between you and Nevin Solutions (Org. No. 936 682 960) (“Theracap”, “we”, “us”), registered at Schøningsdal 3, 7020 Trondheim, Norway. They apply whenever you browse this site or place an order for the Theracap Red Light Therapy Cap. By placing an order you agree to them. If you don’t agree, please don’t place an order.

1. Who can buy from us

You must be at least 18, or the age of majority where you live, and able to form a binding contract, to buy from this site. If you’re buying on behalf of someone else, you confirm you have their permission.

2. Orders, pricing and payment

Prices are shown in USD and don’t include duties or taxes that may apply in your country, which are your responsibility (see Shipping & Returns). Placing an order is an offer to buy, which we accept when we charge your payment method and confirm the order by email — until then, no contract exists.

We may refuse, limit or cancel an order — for example if we suspect fraud, if a price or listing was published in error, or if we’re out of stock — and will refund you in full if we do. Payment is processed by Stripe; we never see or store your full card number. See our Privacy Policy for how Stripe and other processors handle your data.

3. Discounts and promotions

Any discount, sale price or promotional code shown on this site is time-limited and may end or change without notice. A discount code applies only to the order it’s used on and has no cash value.

4. What Theracap Red Light Therapy Cap is — and isn’t

Theracap Red Light Therapy Cap is a general wellness product. It is not a medical device, has not been evaluated by the FDA or any equivalent body, and is not intended to diagnose, treat, cure or prevent any disease. Nothing on this site is medical advice. See our Health & Safety Information page for full details, precautions, and who should talk to a doctor before use. By purchasing, you confirm you’ve read that page and will use the product as instructed in the quick-start guide it ships with.

5. Shipping, returns, guarantee and warranty

Full details — including our 180-day money-back guarantee and 2-year warranty — are on the Shipping & Returns page, which forms part of these Terms. Nothing there, or here, reduces any statutory right you have as a consumer — including your right of withdrawal under Norwegian law (angrerettloven) and any equivalent cooling-off right where you live, and your right to complain about a defect (reklamasjonsrett) under the Norwegian Consumer Purchases Act, which runs at least 2 years and can run longer for goods meant to last longer, or any equivalent minimum guarantee period where you live. Where our guarantee or warranty gives you more than the legal minimum, the better of the two applies.

6. Intellectual property

The Theracap name, logo, product design, photography and site content belong to us or our licensors. You may not copy, resell, or use them commercially without our written permission.

7. Acceptable use

Don’t use this site to do anything unlawful, to attempt to gain unauthorised access to it, to scrape or resell its content, or to interfere with its normal operation.

8. Reviews and other content you send us

If you submit a review, photo or other content to us — for example through a review request email — you confirm it’s honestly your own experience, that you have the right to share it, and you give us permission to publish and edit it (for length or clarity, never for meaning) on this site and in our marketing. We only publish reviews from people who actually bought the product.

9. Disclaimers and limitation of liability

To the fullest extent the law allows, Theracap is provided “as is” without warranties beyond those stated on the Shipping & Returns page or required by law. Our total liability to you for any claim arising from your order is limited to the amount you paid for that order. Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that can’t lawfully be excluded or limited.

10. Governing law and disputes

These Terms are governed by the laws of Norway, and any dispute that isn’t resolved informally will be handled in the ordinary courts of Norway, with Trondheim as the agreed venue — except that, if you’re a consumer, any mandatory consumer- protection law of the country you live in still applies wherever it entitles you to more protection than this section, or requires disputes to be heard there instead. If you’re a Norwegian consumer and we can’t resolve a complaint directly, you can bring it to Forbrukerrådet (the Consumer Council) or Forbrukerklageutvalget (the Consumer Disputes Board). Before starting a formal dispute, please email us at hello@theracap.store — most things are solved a lot faster that way.

11. Changes to these Terms

We may update these Terms from time to time; the “Last updated” date above will change when we do. Continuing to use the site after an update means you accept the revised Terms. We won’t change the terms of an order you’ve already placed.
